Terms & Conditions

  1. First things first;
    1. In these terms, when we say:
      • (a) “you/your”, we mean you, the trade customer;
      • (b) “we/us/our” we mean B & Q PLC (Registered No. 00973387) of B&Q House, Chestnut Avenue, Chandler’s Ford, Eastleigh SO53 3LE (TradePoint is a trading name of B & Q PLC);
      • (c) “Delivery Terms” we mean the terms that apply to our delivery services, full details of which can be found [in store and at www.trade-point.co.uk]
      • (d) “Scheme” we mean the TradePoint Membership Scheme;
      • (e) “membership” we mean membership of the TradePoint Membership Scheme;
      • (f) “Privacy Policy” we mean the terms set out at [e.g. www.trade-point.co.uk]
  2. Your agreement
    1. Your membership of the Scheme and any orders you place are subject to these Terms and Conditions of Membership and Purchase, our Privacy Policy, our Returns Policy, our  Delivery Terms (where relevant), and any additional terms that apply to  promotional or special offers (“together “our agreement”).  You can find the latest version of all our terms online and in store (ask staff for details).
  3. Scheme Membership
    1. You must be 18 or over to apply for membership. If you apply in store, we’ll give you a temporary membership card while we process your application and once you are a member we’ll issue your TradePoint Card. 
    2. TradePoint Cards are personal to the individual named on the card, and for use only in connection with the trade entity named as a member. In stores you must show your card to make a purchase.
    3. TradePoint Cards remain our property. Please give us your card back if we ask for it and tell us immediately if your card is lost, stolen or misused.  Cards should be returned to TradePoint, B&Q House, Chestnut Avenue, Chandler’s Ford, Eastleigh SO53 3LE.
    4. Scheme Membership is at our sole discretion and can be withdrawn at any time.
  4. Buying from us
    1. When you place an order with us, you do so in accordance with the terms of our agreement, subject to our acceptance of your order by us. We accept your order on despatch of the goods ordered by you, unless we have notified you that we do not accept your order or you have cancelled it. The processing of your payment and acknowledgment of your order does not constitute legal acceptance of your order.
  5. Price and availability 
    1. All prices are shown exclusive of VAT. VAT will be added to the prices and will be shown on your invoice / receipt at the current applicable rate. To take advantage of promotional prices, you must quote the relevant promotion code when you order.
    2. Prices exclude delivery charges unless expressly stated otherwise. Delivery charges vary depending on the type of delivery you choose see [e.g. www.trade-point.co.uk/services/delivery] for details.
    3. Quotes are valid until the end date shown in the quote itself, or if no end date is shown, 7 days from the date of the quote. If you provide us with the details on which to base our quote then the quote we give is subject to the accuracy of those details.
    4. We may update prices at any time. Despite our best efforts, a small number of the thousands of products we sell may occasionally be mispriced.  If this happens then we will not be obliged to supply the goods at the incorrect price or at all. We will contact you if this happens.
    5. Prices for commodity goods will be shown as POA (Price on Application). Please ask for details.
    6. We try to hold sufficient stock, but if we don’t have enough to meet your order, we’ll refund you the price paid as soon as reasonably possible and in any case within 30 days or, if you’re a Trade UK Card customer, we may, in our absolute discretion, as soon as possible raise a credit to offset the amount invoiced to you.
  6. Payment
    1. We must receive payment for goods in advance before your order can be processed, unless we have agreed otherwise in advance in writing. 
    2. You are responsible for all orders placed by your authorised employees. You must inform us in writing as soon as a relevant employee is no longer authorised by you to place and receive orders. 
  7. Getting your goods
    1. If you order goods for delivery then the terms that apply to that delivery will depend upon the type of delivery that you choose.  Unless we specifically agree otherwise, we only deliver to mainland UK and Isle of Wight addresses.

    3. Where we have agreed to deliver the goods, we will endeavour to do so on the dates set out in your order, or if no date is specified, within 30 days of the date of your order.
    4. Goods must be signed for on delivery unless we have agreed otherwise.
    5. If you do not receive your goods on the stated delivery date, you must notify us immediately. We recommend that you do not schedule or commence any installation work until after you have received your ordered goods and checked all them for any defects or missing parts.
    6. The goods remain our property until you have paid for them in full. On delivery of the goods to you, the goods shall be at your risk. Until ownership in the goods passes from us, you shall hold the goods on our behalf and shall store the goods at your own cost separately from all other goods in your possession and marked in such a way that they are clearly identified as our property. Once ownership of the goods has passed to you, you may resell or use the goods in the ordinary course of your business. We may, before ownership of the goods passes, require you to deliver up the goods to us and, if you fail to do so, may repossess the goods. You grant us an irrevocable licence to enter, with or without vehicles, any of your premises for the purpose of inspecting or repossessing the goods.
  8. Returns – please read this clause
    1. On receipt of the goods you must check they match your order. If there is any problem, or if they are defective or damaged you must notify us within 48 hours of receipt otherwise you will be deemed to have accepted the goods and we shall not be liable for having supplied the incorrect type and/or quantity nor shall we be liable for any damage or defect.
    2. Providing that you tell us of any problem within 48 hours of receipt of the goods we will, (subject to clause 5) either make good any shortage or non-delivery; or offer you a replacement, repair or refund for the goods in question. Where goods are to be returned to us we will arrange this with you. 
    3. Under our 45 day returns policy, you may return all or part of the goods which you no longer want to us at your own cost (provided they are not incorrect, defective or damaged) by giving us notice within 45 days of the date of your order being placed. For full details, please ask instore.  Goods which have been cut, made to measure or mixed to your requirements cannot be returned under our 45 day returns policy.
  9. Liability – please read this clause
    1. All our obligations to you are set out in our agreement. We are not liable for any loss of profits, income, or business, or for any loss of savings, business interruption or any indirect or consequential losses.
    2. Nothing in our agreement removes or limits our liability for fraud, death or personal injury caused by our negligence or for any liability which can’t be limited or excluded by law. Except as set out in the relevant order or our agreement, all other terms, warranties and conditions implied by statute or common law (including fitness for purpose) are excluded to the fullest extent permitted by law.
    3. Natural products may show some colour variation. We accept no liability associated with such variations.
  10. Our rights to cancel orders
    1. We may cancel any orders by notice in writing to you if you are in breach of our agreement, you become unable to pay your debts when they fall due or proceedings are commenced by or against you alleging bankruptcy or insolvency or an administrator, receiver or administrative receiver is appointed over all or part of your undertaking and assets. Upon cancellation, any money due to us in respect of the cancelled order(s) shall become immediately due and payable and we shall be under no further obligation to supply goods to you.
  11. Events beyond our control
    1. We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, extreme weather conditions, acts of God, strikes, lockouts and other industrial disputes).
  12. Disposal of electrical and electronic equipment
    1. The WEEE regulations aim to ensure waste from certain electrical and electronic equipment is reduced, separated from household waste, and ultimately disposed of in a sound environmental manner. As a trade customer, you agree that the collection, recovery/treatment and disposal of non household electrical or electronic equipment purchased from us will be your responsibility. In the case of household waste, please take this waste to your nearest designated collection facility (DCF). To find your nearest DCF go to www.recycle-more.co.uk. We are making financial contribution towards the running of these facilities and the onward recycling of this waste
  13. Your information
    1. We will use your personal information in accordance with UK data protection and privacy legislation and our Privacy Policy. If you provide us with information about another individual or register another individual for Membership you must have their consent to do so.
    2. You agree that we can process the information you give us, or which we obtain through your dealings with us, for a number of purposes, including managing your membership, to develop and improve the products and services we offer, market research and direct marketing.
    3. B&Q plc is a member of the Kingfisher plc group of companies and, provided that you have given us consent, we may also share information you have given us, or which we obtain through your dealings with us, with other members of the Kingfisher plc group and/or carefully selected third parties who may contact you for marketing purposes.
  14. General
    1. If any of the terms in our agreement are not valid or legally enforceable, the other terms will not be affected. We may replace any term that is not effective with a similar term that is.
    2. Our agreement is governed by and interpreted in accordance with English law and both us and you agree to submit to the non-exclusive jurisdiction of the English courts.
  15. SMS voucher Terms & Conditions
    1. This SMS voucher entitles TradePoint members only to a 10% discount on TradePoint purchases between 4th April and 15th April 2012 when they present the original SMS and take away the items on the day.
    2. Only one voucher per transaction.
    3. Voucher valid for one transaction only.
    4. Offer excludes purchases of gift cards, Worcester Bosch items, and any items for delivery or TP next day.
    5. It cannot be used to pay for delivery or TradePoint next day items, or in conjunction with any other storewide events or promotions, or voucher promotion or B&Q trade or discount card, interest free credit, local markdowns, repair, delivery or installation of goods or concessions or internet – diy. com and nextday.diy.com or bandqappliances.com.
    6. Offer only valid in TradePoint concessions.
    7. The voucher cannot be sold, used to pay a credit transaction, applied retrospectively and is non-transferable.
    8. No cash alternative available.
    9. Forwarded messages will not be accepted.
    10. B&Q reserves the right to reject any voucher it deems, in its sole discretion to have been forged, defaced or otherwise tampered with. Promoter B&Q Plc, B&Q House, Chestnut Avenue, Chandlers Ford, Hampshire SO53 3LE. Registered in England No. 973387.

Customer: Please show your mobile handset with the original SMS to the checkout operator at time of purchase or when placing your order in store.

Store Process: Process through the till by scanning all the products and then enter the promotional number from the text message. It cannot be used for Kitchens, bathrooms, bedrooms, Worcester Bosch items or Direct to site, SAPCO orders or TC next day
